THE CRIMINAL AND HIS RELATIONS WITH OTHERS : AN ANALYSIS OF INTERPERSONAL PROCESSES

This research is concerned with the problem of persistent criminal behaviour. An attempt is made to find its underlying causes and to identify characteristics which remain constant among all criminals. More specifically, these characteristics are looked for in the ways criminals communicate and interact with other people.

The research uses the interpersonal conflict approach. A first hypothesis stipulates that the functions by which an individual relates to others are seriously damaged among criminals. Furthermore, the hypothesis of a precise genetic process involving the deterioration of the capacity to relate to others is formulated. A method of measurement is worked out and applied using the principles and the technique of Kelly's personal constructs theory.

The study is a comparative one and is based on the differential approach. 214 subjects, of whom 121 are criminals and 93 well-adjusted, are tested. The measurement is aimed at the effectiveness of their perceptive reactions toward others. W^ith each group of criminals (recidivists, episodic criminals and juvenile delinquents), a control group is tested for purposes of comparison.

The results are conclusive. At the root of persistent criminal behaviour, the presence of an incompatibility with others is confirmed. This manifests itself concretely in what is termed the feeling of interpersonal withdrawal. All the criminal groups tested show this feeling of withdrawal toward others. The nature and intensity of interpersonal failure is evaluated over three main areas of inter-action : relationship with others in general, relationship with the family of origin and relationship with antisocial peers.

The study attempts to validate a new sociopathology characterizing individuals who have chosen to define themselves by continuous and serious « dissocialized » behaviour.

La présente investigaciôn aborda el problema de la conducta criminal reiterada, esforzândose en precisar lo que esta supone e identificar las carac-teristicas criminôgenas constantes de un criminal a otro. De una manera mas précisa, intenta buscar estas caracterïsticas en los modos de relaciôn con los demâs utilizados por los criminales.

La problemâtica interpersonal o interhumana le sirve de base. Una primera hipôtesis estipula que las funciones de relaciôn con los demâs, que dicha problemâtica implica, estân seriamente deterioradas en los criminales. Se plantea ademâs la hipôtesis de un proceso diacrônico preciso, cuya base séria la capacidad de entrar en relaciôn con los demâs. Gracias a la contri-buciôn de la psicologia de los construidos de G. A. Kelly, ha podido elabo-rarse y aplicarse un instrumento de medida.

La investigaciôn consiste en un estudio comparado basado en el método diferencial. Doscientos catorce individuos .—ciento veintiûn criminales y noventa y très individuos adaptados— fueron sometidos a la prueba de la eficacia de los modos perceptivos de relaciôn con los demâs. Por cada grupo de individuos criminales (reincidentes, criminales de ocasiôn y jôvenes delincuentes), un grupo testigo fué seleccionado con el fin de calcular con precision la influencia de la disocializaciôn.

Los resultados son probantes. Queda confirmada la presencia en la base de la conducta criminal de una incompatibilidad con los demâs concre-tizada en lo que denominamos sentimiento de alejamiento entre el criminal y los otros. A través de la exploraclôn de très grandes sectores de interacciôn —sector de la relaciôn con los demâs, sector de la relaciôn con la familia de origen y sector de la relaciôn con los iguales antisociales— , son evaluadas la naturaleza y la intensidad de las carencias interrelacionales.

La investigaciôn trata, en resumidas cuentas, de validar la axiomâtica de una sociopatologia inédita que caracterizaria a los individuos que han escogido el definirse por una disocializaciôn incesante.

Dièse Untersuchung beschaeftigt sich mit dem Problem des Verhaltens von Gewohnheitsverbrechern. Sie bemueht sich, die zu Grunde liegenden Motive deutlich zu machen und alien Verbrechern eigene Charakteristiken ausfindig zu machen. Genauer gesagt, dièse Charakteristiken werden in den Beziehungen gesucht, die der Verbrecher mit seiner Umwelt pflegt.

Die Untersuchung stuetzt sich auf den interpersoenlichen oder zwischen-menschlichen Konflikt. In einer ersten Hypothèse wird behauptet, dass die persoenliche Beziehung zum Mitmenschen, die diesen Konflikt mit sich bringt, beim Kriminellen wesentlich verkuemmert ist. Darueber hinaus wird die Hypothèse eines genauen genetischen Prozesses formuliert, der seinen Sinn in der Deteriorisierung der Faehigkeit, mit anderen in Beziehung zu treten, sieht. Dank des Beitrags der Psychologie des persoenlichen Aufbaus (G.A. Kelly s personal constructs theory) ist ein Messinstrument ausgearbeitet worden, das seine Anwendung findet.

Es handelt sich um eine vergleichende Studie, die auf differenzierten Annaeherungen beruht. 214 Probanden, von denen 121 kriminell und 93 wiedereingegliedert sind, werden einer Pruefung unterzogen, wie wirksam die perzeptiven Arten sind, mit dem Mitmenschen in Beziehung zu treten. Fuer jede Gruppe von Kriminellen (Rueckfaellige Verbrecher, Zufallsverbrecher und jugendliche Delinguenten) wurde zu Vergleichszwecken eine Kontroll-gruppe getestet.

Die Ergebnisse sind auffallend. An der Wurzel wiederholten kriminellen Verhaltens bestaetigt sich die Unvereinbarkeit mit dem Anderen, die

sich in einer, wie wir sie nennen, zwischenmenschlichen Entfremdung aus-drueckt. Alle kriminellen Gruppen sind durch dieses Gefuehl der Entfremdung zwischen sich selbst und den Mitmenschen gepraegt. Die Natur und Dichte dieser zwischenmenschlichen Leere sind auf drei wichtigen Gebieten zwischenmenschlicher Beziehungen gemessen : in dem Verhaeltnis mit anderen im allgemeinen, in der Beziehung mit der eigenen Blutsverwandtschaft und in der Beziehung mit antisozialen Partnern.

Die Studie bemueht sich, einer neuen Soziopathologie Geltung zu verschaffen, die Individuen danach charakterisiert, wie sie sich selbst durch fortdauerndes und schwerwiegendes dissoziales Verhalten definieren.

But de l'etude. Cette recherche entreprise par le ministere de l'Education dans certains bas-quartiers d'Israel a pour origine la theorie sociologique selon laquelle la deviance et la delinquance sont associees aux conflits de l'enfant qui appartient a des groupes divers. Le traitement vise a arreter ces pressions diverses en utilisant l'appartenance de l'enfant au groupe comme agent de traitement, et c'est pourquoi les travailleurs sociaux ont du s'integrer au groupe pour tenter de changer son systeme normatif. Ce rapport traite

des problemes d'evaluation et de mesure objective des resultats obtenus par les efforts de correction et de prevention des travailleurs sociaux.

Apercu theorique sur un schema pour l'etude de la delinquance en Israel. Dans un pays ou l'on denombre plus de 70 groupes ethniques, les conflits de normes peuvent etre hautement significatifs pour expliquer la genese du crime et de la delinquance. Ce probleme majeur de conflit de culture qui nait avec la deuxieme generation n'est cependant qu'un facteur predisposant dans un ensemble plus vaste. Le schema propose synchronise deux types d'explications causales : une configuration de facteurs predisposants ; une chaine de pressions dynamiques qui conduisent un individu donne a s'associer a des groupes criminels et a adopter leur type de conduite.

Schema des {acteurs sociaux de conduite criminelle applique hypothe-tiquement a l'etiologie du crime et de la delinquance en Israel. Pour l'ensemble predisposant sont envisages les points suivants : cellule familiale ; facteurs ecologiques ; facteurs economiques ; conflit de culture. Le processus dynamique d'association considere les points suivants : solutions delinquantes de situations conflictuelles ; identification differentielle ; stigmate social ; sous-culture criminelle.

Methode. Deux groupes ont ete choisis pour definir empiriquement le continuum mesure. Apres interview, les deux groupes ont ete compares en utilisant le test Mann-Whitney et le test x2. Les principaux points de distinction entre groupe delinquant et groupe non delinquant ont ensuite ete analyses afin d'etablir leur contribution relative.

Questionnaire. Dans une premiere partie, le questionnaire comprend differentes questions concernant le passe socio-economique de l'enfant et de sa famille. La deuxieme partie est un ensemble d'inventaires eprouves anterieurement. La troisieme partie groupe les points concernant la conscience qu'ont les jeunes de la structure differentielle et du processus de stigmatisation.

Resultats. On a tente de maintenir stables les variables des facteurs demographiques. L'anomie a ete consideree comme facteur predisposant. Apres verification, il ne semble pas que l'anomie soit un facteur significatif de la delinquance. Les differents points des inventaires qui differencient veritablement les delinquants des non-delinquants ont ensuite ete analyses et les plus significatifs sont indiques dans chaque inventaire.

Identification dynamique et processus d'association. Les principes d'association differentielle ont ete largement verifies par cette etude et formules sous forme de probabilite. Cette etude a aussi verifie la theorie de la desorganisation familiale et du conflit de culture lie a l'immigration familiale. Le concept de norme viciee conduisant a une socialisation precoce est crucial pour le concept global de la delinquance.

Objeto del estudio. La investigacion emprendida por el ministerio de Educacion en algunos barrios bajos de Israel se basa en la teoria sociologica segun la cual tanto la conducta desviante como la delincuencia juvenil estan asociadas con los conflictos del nino perteneciente a varios grupos. El tratamiento tiende a suprimir taies presiones, utilizando como agente de tratamiento la pertenencia del nino al grupo ; por ello los trabajadores sociales han tenido que integrarse al grupo, con el fin de intentar cambiar su sistema normative. El presente trabajo trata de los problemas de evaluacion y medida objetiva de los resultados obtenidos por los esfuerzos penales y pre-ventivos de dichos trabajadores sociales.

Resumen teorico de un modelo para el estudio de la delincuencia juvenil en Israel. En un pais donde pueden contarse mas de 70 grupos etnicos, los conflictos de normas pueden ser extremadamente relevantes para comprender la genesis del crimen y de la delincuencia. Sin embargo, este problema mayor de conflicto de culturas, que surge en la segunda generacion, no es mas que un factor predisponente en un conjunto de factores mucho mas vasto. El

esquema propuesto sincroniza dos tipos de explicaciones causales : una configuracion de factores predisponentes ; una serie de presiones dinamicas que conducen a un individuo dado a asociarse con grupos criminales y adoptar sus tipos de conducta.

Esquema de ?actores sociales de conducta criminal aplicado hipoteticamente a la etiologia del crimen y de la delincuencia en Israel. Los puntos siguientes son considerados para el conjunto de factores predisponentes : unidad familiar ; factores ecologicos ; factores economicos ; conflicto de culturas. El proceso dinamico de asociacion tiene en cuenta los puntos siguientes : soluciones delincuentes de las situaciones de conflicto ; identificacion diferencial ; estigma social ; sub-cultura criminal.

Metodo. Para definir empiricamente el continuum medido, se han escogido dos grupos. Despues de haber sido interviuvados, los dos grupos fueron comparados, utilizandose para ello los tests Mann-Whitney y x2-Los puntos que distinguian significativamente el grupo delincuente y el no delincuente fueron entonces analizados con el fin de determinar su contribucion relativa.

Cuestionario. La primera parte comprendia varias cuestiones referentes a los antecedentes socio-economicos del nino y de su familia ; la segunda, un conjunto de inventarios experimentados previamente ; la tercera, los puntos relativos al conocimiento que tienen los jovenes de la estructura diferencial y del proceso de estigmatizacion.

Resultados. Se ha intentado mantener constantes las variables de los factores demograficos, considerandose la anomia como factor predisponente. Despues de haberse efectuado la correspondiente comprobacion, parece ser que la anomia no predispone de manera significativa a la delincuencia. Los diversos puntos de los inventarios que permiten distinguir verdaderamente a los delincuentes de los no delincuentes fueron seguidamente analizados, indicandose en cada inventario los mas significativos.

Identificacion dinamica y proceso de asociacion. Los principios de asociacion diferencial han sido ampliamente verificados por este estudio y formulados en forma de probabilidad. Tambien se han comprobado las teorias de la desorganizacion familiar y del conflicto de culturas unido a la inmigracion familiar. El concepto de norma viciada conduciendo a una socializacion precoz es crucial para el concepto general de delincuencia.

Ziel der Untersuchung. Diese Untersuchung, die vom Erziehungsministerium in einigen israelischen Elendsquartieren unternommen worden ist, hat die soziologische Theorie zur Grundlage, nach der abweichendes Verhalten und Kriminalitaet mit den Konflikten des Kindes eng verbunden sind, das verschiedenen Gruppen angehoert. Die Behandlung versucht, diese verschiedenartigen Pressionen aufzuhalten, indem sie die Zugehoerigkeit des Kindes zur Gruppe als Behandlungsmittel benuetzt ; deshalb haben sich die Sozialarbeiter der Gruppe anpassen muessen, um zu versuchen, sein normatives System zu veraendern. Dieser Bericht eroertert die Probleme, die sich durch die Besserungs— und Praeventiwersuche der Sozialarbeiter bei der Analyse und objektiven Auswertung der erhaltenen Resultate ergeben haben.

Kurzer Abriss eines Schemas fuer die Forschung der Delinquenz in Israel. In einem Land, in dem 70 ethnische Gruppen vorherrschen, koennen die Normkonflikte ueberaus bedeutsam fuer die Genesis des Verbrechens und der Delinquenz sein. Dieses wichtige Problem des Kulturkonfliktes, das mit der zweiten Generation entsteht, ist hingegen nur ein vorherrschender Faktor in einem viel umfangreicheren Gesamten. Das vorgeschlagene Schema verdeutlicht zwei Typen kausaler Erklaerungen : ~- ein Zusammenwirken praedisponierender Faktoren ; eine Kette von dynamischen Pressionen, die ein gegebenes Individuum dazu fuehren, sich Gruppen von Verbrechern anzuschliessen und deren Verhalten zu uebernehmen.

Schema der sozialen Faktoren kriminellen Verhaltens, das hypothetisch auf die Verbrechensethiologie und die Delinquenz in Israel angewendet wird. Fuer das praedispositive Gesamte werden die folgenden Punkte ins Auge gefasst : die Zelle der Familie ; ekologische Faktoren ; oekonomische Faktoren ; Kulturkonflikt. Der dynamische Prozess der Sich-Annaeherung betrachtet die folgenden Punkte : Loesungen von Konfliktssituationen durch delinquentes Verhalten; differenzierte Identifikation; soziales Stigma; kriminelle Subkultur.

Methode. Zwei Gruppen wurden ausgewaehlt, um empirisch das gemessene Kontinuum zu bestimmen. Nach dem Interview wurden die beiden Gruppen miteinander verglichen, wobei der Mann-Whitney und der %2 Test angewandt wurden. Ehe vorwiegenden Unterscheidungspunkte zwischen der delinquenten und nicht delinquenten Gruppe wurden daraufhin analysiert, um ihren dementsprechenden Beitrag zu bestimmen.

Fragebogen. In einem ersten Teil umfasst der Fragebogen verschiedene Fragen, die die sozio-oekonomische Vergangenheit des Kindes und seiner Familie betreffen. Der zweite Teil stellt eine Gesamtheit schon vorher geprueften und bewiesenen Materials dar. Der dritte Teil befasst sich mit den Punkten, die Aufschluss geben ueber das Bewusstsein, das die Jungen von der differenzierten Struktur und dem Stigmatisierungsprozess haben.

Resultate. Man hat versucht, die Variablen der demographischen Faktoren im Gleichgewicht zu halten. Die Anomie ist hierbei als vorwiegender Faktor betrachtet worden. Nach der Analyse scheint es nicht so zu sein, dass sich die Anomie wesentlich der Delinquenz beugt. Die verschiedenen Gesichtspunkte des gegebenen Materials, die wesentlich die Delinquenten von den Nicht-Delinquenten unterscheiden, wurden daraufhin analysiert und die bedeutsamsten von ihnen im entsprechenden Inventar verzeichnet.

Dynamische Identifikation und Prozess des Sich'Anschliessens. Die Grundsaetze differenzierten Anschlusses haben sich durch diese Untersuchung deutlich bestaetigt und sind in der Form von Wahrscheinlichkeit (probability) ausgedrueckt worden. Die Studie hat ebenfalls die Theorie von der Familienzersplitterung und des Kulturkonfliktes, der mit der Immigration zusammenhaengt, gestuetzt. Das Konzept der verkannten Norm, das zu einer fruehzeitigen Sozialisierung fuehrt, ist von groesster Bedeutung fuer das gesamte Konzept der Delinquenz.

SYNTHESIS OF THE FIRST INTERNATIONAL SYMPOSIUM FOR RESEARCH IN COMPARATIVE CRIMINOLOGY

Introduction

At the beginning of the development of the social sciences there was a considerable vogue for comparative research. A long period of empirical studies and almost total preoccupation with methodological problems followed. Once again, however, psychology, political science, sociology, and above all anthropology, have taken up the thread of this tradition, and the bibliography in these fields is becoming ever more abundant. The study of deviance, of various manifestations of criminality, and of social reaction against crime are, however, noticeably missing in the picture, even though there is nothing in the nature of criminology which precludes the development of comparative research.

To many research workers in criminology, the time seemed ripe to take up the comparative tradition once again. Two imperatives were considered : the generalization of norms of deviance which are tied to the standard of living set by industrial civilization, thus putting the problem of criminality in a global light ; and, second, the development and standardization of methods of studying these phenomena, drawing on the experience of allied disciplines.

The response of the participants in this Symposium and the results of their discussions were not unexpected. A consensus was arrived as to the problems it was thought important to study, and agreement was reached about the strategies of research to be undertaken. Priorities, however, were not established since too much depends on the availability of research teams, funds, etc. But the broad, overall look at the main problems in comparative criminology will, hopefully, open a new chapter in the history of crimino-logical research and in our continuing search for knowledge of man and society.

The brief resume which follows should give the reader an idea of the extent of the problems tackled. The detailed proceedings of the Symposium will be published at a later date, in mimeographed form.

Sectors of research proposed

In a sense, this Symposium was prepared by all the participants. The

organizers had requested that each person invited prepare a memorandum setting out the problems in comparative criminology which he considered to be most important. The compilation of their replies, reported to the plenary session at the opening of the Symposium, produced the following results :

Discussions

The discussions at the Symposium were based on these suggestions, the main concentration falling on problems of manifestations of violence in the world today, the phenomenon of student contestation, and on human rights and the corresponding responsibilities attached thereto.

Although the participants did not come to definite conclusions as to the respective merits of the problems submitted for consideration, they did discuss the conditions under which comparative studies of these problems should be approached, the techniques appropriate to obtaining valid results, and the limitations on this type or work.

Four workshops were established and studied the various problems. The first tackled the problems of the definition of the criteria of « danger » represented by different type of criminals ; the problem of discovering whether the value system which underlies the Human Rights Declaration corresponds to the value system of today's youth; the problem of the treatment of criminals ; of female criminality ; and, finally, of violence in the form of individual and group manifestations. The second workshop devoted its main consideration to the revolt of youth and to organized crime, also proposing that an international instrument bank of documentation and information be established. The third workshop considered problems of theory : how the police and the public view the criminal ; the opportunity of making trans-cultural comparisons on such subjects as arrest, prison, etc. ; and the role of the media of information in the construction of value systems. The fourth workshop blazed a trail in the matter of methodology appropriate to research in comparative criminology.

The period of discussions which followed the report of the four workshops gave rise to a confrontation between two schools of thought within the group of specialists. The question arose as to whether the problem of student contestation falls within the scope of the science of criminology. Several experts expressed the opinion that criminologists ought not to concern themselves with a question which really belongs in the realm of political science.

On the other hand, the majority of the participants appeared to feel that the phenomenon of student contestation did indeed belong in the framework of criminological research. One of the experts in particular took it upon himself to be the spokesman of this school of thought. There are those, he said, who feel that criminology should confine itself and its research to known criminality, to hold-ups, rape, etc. However, one should not forget that penal law rests on political foundations, the legality of power, a certain moral consensus of the population. Today, it is exactly this « legitimate » authority that is being contested. Is it not to be expected, therefore, that criminology should show interest in all sociological phenomena which have legal and criminal implications ? Contestation and violence have consequences for the political foundations of penal law, and therefore are fit subjects for the research of the criminologist.

International Centre {or Comparative Criminology

The First International Symposium for Research in Comparative Criminology situated itself and its discussions within the framework and in the perspectives opened by the founding of the International Centre for Comparative Criminology. The Centre is sponsored jointly by the University of Montreal and the International Society for Criminology, with headquarters at the University of Montreal. As one of the participants emphasized, criminologists need a place to retreat from the daily struggle, to meditate, to seek out and propose instruments of research valid for the study of problems common to several societies. Viewing the facts as scientists, we are looking for operational concepts. Theoreticians and research workers will rough out the material and, hopefully, this will inspire conferences and symposiums of practitioners, jurists, sociologists, penologists, and other specialists. Above all, it will give common access to international experience, something which is lacking at present both at the level of documentation and of action. A bank of instruments of method-

ology in the field of comparative criminology does not exist at the present time. The Centre will undertake to compile and analyse research methods used in scientific surveys, and it will establish such an instrument bank. It will also gather and analyse information pertaining to legislative reforms now in progress or being contemplated in the field of criminal justice. Through the use of computers, the Centre will be able to put these two projects into effect and make the results easily accessible to research workers, and to all those concerned in this field.

The participants at the Symposium were given a view of the extent of the problems envisaged for research by the future Centre. It is hoped that this initiative will be of concrete use to research workers, private organizations, public services and governments at many levels, and in many countries.

SINTESIS DEL PRIMER SIMPOSIUM INTERNACIONAL DE INVESTIGACION EN CRIMINOLOGIA COMPARADA

El Primer Simposium internacional de investigacion en criminologia comparada se inaugure con la presentacion de un conjunto de sugestiones enviadas por los participantes, en las que indicaban los temas que, a su parecer, debieran gozar de prioridad por Io que atafie a la investigacion criminologica comparada. Dichos temas pueden ser reducidos a los diez grupos siguientes : 1) definiciones y conceptos ; 2) procedimiento ; 3) personal; 4) causalidad : situaciones similares a la criminalidad ; 5) varie-dades de crimenes y criminales ; 6) tratamiento : evaluacion ; 7) investigacion metodologica ; 8) estadisticas ; 9) formacion del investigador ; 10) equipo : comite de coordinacion.

Discusiones

Las discusiones del simposium tuvieron por objeto las sugestiones presentadas ; los puntos mas discutidos fueron las manifestaciones de violen-cia actuales, el fenomeno de la contestacion estudiantil y los derechos y deberes del individuo.

Aunque no se llego a un acuerdo definitivo sobre los meritos respec-tivos de cada problema, si se discutieron las condiciones necesarias para su estudio comparado, las tecnicas apropiadas para obtener resultados vali-dos y los limites de este tipo de trabajo.

Cuatro grupos de trabajo fueron formados, los cuales estudiaron varios temas. El primer grupo trato de los problemas de la definicion del criterio de « peligro » que representan diversos tipos de criminales; de descubrir si el sistema de valores que constituye la base de la Declaracion de los derechos del hombre corresponde al de la juventud actual ; del tratamiento de los delincuentes ; de la criminalidad femenina ; y finalmente, del fenomeno de la violencia, individual o collectiva. El segundo grupo dedico su mayor atencion al estudio de la rebelion de la juventud y del crimen organizado ; tambien propuso que se creara un banco internacional de instrumentas de documentation e information. El tercer grupo trato de problemas de tipo teorico : como ven al criminal la policia y el publico ; oportunidad de hacer comparaciones trans-culturales sobre el arresto, la prision, etc. ; roi de los medios de informacion en la elaboration de un sistema de valores. Finalmente el cuarto grupo aborde el dificil problema de la metodologia de la investiqacien en criminologia comparada.

El periodo de discusion que siguio a la exposicion del trabajo de los cuatro grupos, origine una confrontacion entre dos escuelas de pensamiento. La cuestion litigiosa consistia en saber si el problema de la contestacion estudiantil debe ser tratado por la ciencia criminologica.

Algunos especialistas expresaron la opinion que la criminologia no debe estudiar una cuestion que pertenece al campo de la ciencia politica. Sin embargo, la mayoria de los participantes afirmaron que este fenomeno debe ser objeto de estudio de la investigacion criminologica. Uno de los criminologos presentes, en particular, hizo observar que aunque hay que creer que la criminologia deberia reducirse a estudiar la criminalidad, los

asaltos a mano armada, el rapto, etc, no conviene olvidar que la ley penal se basa en consideraciones politicas, en la legalidad del poder, en el consentimiento moral de la poblacion. Ahora bien, si se tiene en cuenta que lo que actualmente se pone en duda es precisamente la « legitimidad » de dicha autoridad, parece logico que la criminologia se interese por este problema, cuyas implicaciones legales y criminales son evidentes.

El Centro internacional de criminologia comparada

Se estudiaron durante el Simposium las perspectivas abiertas por la creacion del Centro internacional de criminologia comparada. Dicho organismo, con sede en Montreal, esta patrocinado conjuntamente por la Universidad de Montreal y la Sociedad internacional de criminologia. Se insistio en la necesidad para el criminologo de un lugar a donde poder retirarse para meditar, buscar y proponer metodos e instrumentos de investigacion validos para el estudio de problemas comunes a varias sociedades. Puesto que la criminologia considera los hechos desde un punto de vista cientifico, urge el encontrar conceptos operacionales adecuados. De esta manera, los investigadores podran mejorar el material existente, lo que permitira y facilitara la celebracion de conferencias y coloquios de practicos, juristas, sociologos, penalistas y demas especialistas y, sobre todo, dara comun acceso a algo que falta actualmente, un banco de documentacion en criminologia comparada.

Pasaran meses, incluso anos, antes de que puedan compararse los elementos compilados. Sin embargo, gracias al uso de compiladores y demas instrumentos tecnicos modernos, el Centro podra construir un tal banco y ponerlo a la disposicion tanto de los investigadores particulares como de los gobiernos que lo soliciten.

Los participantes al Simposium pudieron de esta manera apreciar la importancia y extension de los problemas que seran estudiados por el Centro internacional de criminologia comparada. Es de esperar que las organizaciones privadas y publicas, asi como los gobiernos, utilicen realmente los servicios que dicho organismo les ofrece.

Das Erste Symposium fuer Forschung in Vergleichender Kriminologie wurde mit der Praesentierung einer ganzen Menge von Vorschlaegen eroeffnet, die von den Teilnehmern uebermittelt worden waren und jene, die ihnen am wichtigsten erscheinenden Forschungsprojekte fuer vergleichende Kriminologie darstellten. Diese gruppierten sich um zehn vorwiegende Problemkreise : 1) Definitionen und Konzepte; 2) Verfahren; 3) Mitarbeiterstab ; 4) Ursachenlehre : Gegebenheiten, die mit der Kriminalitaet in Verbindung stehen ; 5) Verschiedenheiten von Verbrechen und Verbrechern ; 6) Behandlung : Auswertung ; 7) Methoden der Forschung ; 8) Statistik : Epidemiologie; 9) Ausbildung von wissenschaftlichen Forschern; 10) Instrumentarium : Koordinationskomitee.

Diskussion

Die Aussprachen des Symposiums beruhten auf diesen Vorschlaegen ; das Hauptgewicht lag auf dem Problem, wie sich die Gewalt in der heutigen Zeit manifestiert ; das Phaenomen studentischen Aufruhrs stand im Mittelpunkt und als weiteres die Menschenrechte und die mit ihnen zusammenhaengenden Verantwortlichkeiten.

Obwohl die Teilnehmer nicht darueber einig werden konnten, welchen Problemen der Vorrang gegeben werden sollte, so berieten sie doch ueber die Voraussetzungen, unter denen vergleichende Studien dieser Projekte betrieben werden sollte; die Technik, gueltige Resultate zu erhalten, und schliesslich die Beschraenkung auf diese Art von Taetigkeit.

Es wurden vier Arbeitsgruppen geschaffen, die verschiedene Probleme studieren sollten. Die erste beschaeftigte sich mit der Aufgabe, Kriterien fuer eine Definition des Begriffs der « Gefaehrlichkeit » zu finden,

wie man sie bei verschiedenen Verbrechertypen vorfindet ; dem Problem, herauszufinden, ob das Wertsystem, das der Menschenrechtserklaerung zugrunde liegt, dem Wertsystem der heutigen Jugend entspricht : dem Problem der Behandlung von Verbrechern ; der Kriminalitaet von Frauen und schliesslich dem Problem der Gewalt in Form individueller und Gruppen-manifestationen. Die zweite Arbeitsgruppe widmete ihre Aufmerksamkeit dem Aufruhr unter der Jugend und dem organisierten Verbrechen, wobei sie vorschlug, dass eine internationale Dokumentations- und Informations-stelle geschaffen werde. Die dritte Arbeitsgruppe eroerterte theoretische Probleme : wie die Polizei und die Oeffentlichkeit den Verbrecher sehen ; die Moeglichkeit, transkulturelle Vergleiche ueber Themen wie die Verhaf-tung, den Strafvollzug usw. anzustellen; weiterhin diskutierten sie die Aufgabe der Informationsmedia beim Aufbau eines Wertsystems. Die vierte Arbeitsgruppe schlug eine Schneise in das Gebiet der Methodologie, die anzu-wenden sei auf dem Gebiet vergleichender Kriminologie.

Die Diskussionszeit, die den Berichten der vier Arbeitsgruppen folgte, gab Anlass zu einer Gegenueberstellung zweier Schulen innerhalb der Spezialistengruppe. Die Frage wurde aufgeworfen, ob das Problem des studentischen Aufruhrs wirklich in das Gebiet der kriminologischen Wis-senschaft falle. Einige Experten waren der Auffassung, dass sich die Kri-minologen nicht mit Dingen beschaeftigten sollten, die in Wirklichkeit im Rahmen der politischen Wissenschaften abgehandelt werden sollten. Auf der anderen Seite war die Mehrheit der Teilnehmer der Auffassung, dass das Phaenomen der Studentenunruhen Aufgabe kriminologischer Forschung darstelle. Vor allem einer der Experten nahm es auf sich, sich zum Sprecher dieser Schule zu machen. Es gibt diejenigen, meinte er, die das Gefuehl haben, dass sich die Kriminologie darauf beschraenke, die Kriminalitaet zu erforschen, die Ueberfaelle, die Notzucht usw. Indessen sollte man nicht vergessen, dass Strafgesetze auf politischer Basis beruhen, auf der Legali-taet der Machtausuebung und einer gewissen moralischen Zustimmung der Bevoelkerung. Heute ist es genau diese « legitime Autoritaet », die bestritten wird. Sollte man deshalb nicht erwarten koennen, dass sich die Kriminologie fuer aile soziologischen Phaenomene interessiert, die gesetzliche und kriminelle Zusammenspiele haben ? Demonstrationen und Gewalt haben Konsequenzen fuer die politische Grundlage des Strafgesetzes und sind deshalb geeignete Themen fuer die kriminologische Forschung.

Das Internationale Zentrum fuer Vergleichende Kriminologie

Das Erste Internationale Symposium fuer Forschung in Vergleichender Kriminologie stellte sich selbst und seine Diskussionen in den Rahmen und die Moeglichkeiten, die sich durch die Gruendung eines Internationalen Zentrums fuer Vergleichende Kriminologie ergaben. Das Zentrum steht unter der Patronage vor allem der Universitaet von Montreal und der Internationalen Kriminologischen Gesellschaft und hat seinen Sitz an der Universitaet von Montreal. Wie einer der Teilnehmer hervorhub, Krimi-nologen brauchen einen Platz, wo sie sich vom taeglichen Kampf zurueck-ziehen koennen, ran nachzudenken, zu forschen und urn Forschungspro-jekte vorzuschlagen, die geeignet sind, von verschiedenen Gesellschaften bearbeitet zu werden. Da wir die Dinge als Wissenschaftler betrachten, suchen wir Konzepte, die bearbeitbar sind. Theoretiker und Forscher werden das Material durchroden, und das wird hoffentlich Anlass geben zu Konfe-renzen und Symposien fuer Praktiker, Juristen, Soziologen, Poenologen und andere Experten. Darueber hinaus wird es eine gemeinsame Tuere oeffnen fuer eine ueber aile Laender reichende Erfahrungsgrundlage, die heute noch weitgehend fehlt. Eine Dokumentationsstelle auf dem Gebiet vergleichender Kriminologie gibt es zur Zeit nicht, und es wird einige Monate, wenn nicht Jahre in Anspruch nehmen, um die Grundlagen hier-fuer zu sammeln. Mit dem Gebrauch der Computer wird das Zentrum in der Lage sein, eine solche Stelle wirksam zu gestalten und fuer Forscher und Regierungen zugaenglich zu machen.

Die Teilnehmer des Symposiums konnten die Tragweite der Pro-blematik sehen, die das zukuenftige Zentrum mit sich bringt. Es waere zu

hoffen, dass diese Initiative einen konkreten Nutzen fuer private Organisationen, oeffentliche Dienste und die Regierungen haben wird.
